Last updated: 24 October 2026

1. Introduction

Welcome to Multimedia Creative Design.

  • These Terms & Conditions govern the use of our website, https://multimediacreativedesign.uk, and the provision of our professional digital services.
  • Multimedia Creative Design is currently operated as a sole-trader business in the United Kingdom.
  • By commissioning our services or entering into a service agreement, you agree to the terms expressly provided to you and accepted before the contract is formed.
  • Browsing our website alone does not constitute acceptance of a paid service agreement.
  • Nothing in these Terms & Conditions excludes or restricts rights that cannot lawfully be excluded.

2. Our Services

We provide digital and creative services, including:

  • Website design and development

  • Graphic design and branding

  • Search engine optimisation (SEO)

  • Website maintenance and technical support

  • Video editing and multimedia production

  • Website performance optimisation

  • Digital marketing and related services

The specific services, deliverables, prices, timelines and responsibilities for each engagement will be set out in a written quotation, proposal or service agreement.

3. Quotations and Project Agreements

  • Quotations are based on the information and requirements supplied by the client.
  • A contract is formed when the client accepts our quotation or agreement and we confirm acceptance, or when services begin under an otherwise valid agreement.
  • Any changes to the agreed scope may require an additional quotation, revised price or adjusted delivery schedule.
  • We will communicate material changes for the client’s approval before proceeding.

4. Project Payments and Deposits

  • For custom projects, we generally require an initial deposit before work begins, with the remaining balance payable at the agreed completion stage or milestone.
  • The deposit amount, total project price and payment schedule will be confirmed before the project is accepted.
  • Invoices must be paid by their stated due dates.
  • If payment is delayed, we may suspend further work after providing reasonable notice, subject to applicable law and the terms of the relevant agreement.
  • Cancellation charges and refunds are governed by our Refund & Cancellation Policy and applicable statutory rights.

5. Monthly Subscription Services

  • This section applies only to separately purchased monthly subscription services, including website maintenance, SEO and ongoing technical support.
  • These subscriptions are optional and are not included in the one-time Starter Website development fee.
  • Each subscription begins on the commencement date confirmed in the relevant subscription agreement, which may be different from the website’s go-live date.
  • Annual website hosting and domain renewals are governed separately by Section 9 and are not subject to the monthly subscription cancellation procedure in this section.

5.1 Minimum Commitment

  • Certain ongoing services, including website maintenance, SEO and technical support, may be provided through monthly subscriptions.
  • Unless otherwise agreed in writing, these subscriptions have an initial minimum contractual term of 12 months, with monthly payments processed through Stripe.
  • The applicable price, service scope, billing dates, minimum commitment and cancellation conditions will be disclosed before the client enters into the subscription.

5.2 Continuation After the Initial Term

  • Following the initial 12-month term, the subscription automatically continues on a monthly rolling basis.
  • The automatic continuation does not create a further 12-month minimum contractual commitment.

5.3 Cancellation Notice

  • Clients may request cancellation at the end of the initial minimum term or during the subsequent monthly rolling period.
  • Our standard contractual notice period is 14 days in writing, subject to any overriding statutory rights.
  • Cancellation requests should be sent to multimediacreativedesigner@gmail.com.
  • We will confirm receipt, the effective cancellation date and when recurring billing will stop.
  • Any final charge must be consistent with the agreed billing cycle, the contract and applicable law.

5.4 Early Termination

  • Requests to terminate during the initial 12-month period may be considered where the client has a substantial or justified reason.
  • We may agree to early termination and any associated financial arrangements in writing.
  • This discretionary process does not limit any legal right to cancel or terminate, including rights arising from our breach of contract.

5.5 Recurring Payments

  • Subscription payments are collected through Stripe according to the billing schedule agreed with the client.
  • Clients are responsible for maintaining a valid payment method.
  • Failed payments may result in reasonable reminders or suspension of services, where contractually and legally permitted.

6. Client Responsibilities

Clients agree to provide accurate project information, required content, relevant access credentials, timely feedback and necessary approvals.

  • Clients must ensure that materials they provide may lawfully be used for the project and do not infringe third-party rights.
  • Where client delays affect delivery, we may reasonably adjust the project schedule after notifying the client.

7. Project Delivery and Revisions

  • We will provide services with reasonable care and skill.
  • Project timelines are estimates unless a binding deadline is expressly agreed.
  • The number and scope of included revisions will be specified in the relevant quotation or service agreement.
  • Requests outside the agreed scope may incur additional charges, subject to prior approval.

8. Website Ownership, Intellectual Property and Licensing

8.1 Website Ownership Models

  • Multimedia Creative Design offers two website development arrangements:

A. Client-Owned Website: A website developed under an agreement that provides for the transfer of specified intellectual property rights to the client following completion and full payment.

B. Managed Website: A website developed, hosted and managed by Multimedia Creative Design, under which the client receives agreed usage rights rather than automatic ownership of our proprietary website materials.

  • The selected arrangement, applicable fees, intellectual property rights, hosting responsibilities and transfer conditions will be clearly confirmed in writing before the project begins.

8.1-A Starter Website Package – From £550

  • Our Starter Website package starts from £550 as a one-time website development fee for a standard three-page website.
  • Clients can choose between two arrangements:

Client-Owned Website

  • The client pays the agreed website development fee and separately covers hosting, domain registration, renewals and any other required third-party services.
  • Following project completion and full payment, Multimedia Creative Design provides the agreed website handover and transfers the specified rights in original custom-created work under a written agreement. No ongoing subscription with Multimedia Creative Design is required unless separately agreed.

Managed Website

  • The client pays the agreed one-time website development fee. Website hosting and domain registration are included for the initial 12 months.
  • After the first 12 months, continued hosting and domain renewal are chargeable at the rates and on the billing terms disclosed and agreed before the client enters into the arrangement.
  • Under this model, the client receives the agreed website usage rights. Ownership of Multimedia Creative Design’s proprietary development materials does not automatically transfer.
  • A separate maintenance, SEO or technical support subscription is not included or required unless expressly agreed.
  • Clients wishing to purchase transferable website rights and migrate to another provider may do so under the buyout and transfer conditions agreed in writing before the project begins.
  • Additional pages, e-commerce functionality, booking systems, custom integrations and other add-ons are quoted separately.
  • Third-party software, licences, client-owned content and domain registration rights remain subject to their respective applicable terms.

8.2 Client-Owned Websites

  • Where a Client-Owned Website arrangement has been agreed, the client will receive the agreed deliverables, website files, administrative access and relevant handover information after project completion and full payment.
  • The agreed intellectual property rights in original custom-created work will be assigned through an appropriate written agreement signed as required by law.
  • Third-party software, plugins, themes, fonts, stock assets, licences and pre-existing development tools remain subject to their respective ownership and licensing arrangements.
  • The Managed Website development fee covers the agreed website design and development work and the initial 12-month hosting, domain and hosting-related security package, as specified in the client’s quotation.
  • Website maintenance, SEO, content updates, ongoing development work and other recurring support services are not included unless expressly stated in the quotation or a separate subscription agreement.
  • The client’s agreed website usage licence, domain registration rights, hosting arrangements and any buyout or migration options will be set out in the Managed Website Agreement.

8.4 Website Buyout and Transfer

  • Clients using a Managed Website may request to purchase the agreed transferable intellectual property rights and migrate the website to another hosting provider or developer.
  • The website buyout price, or an objectively defined method for calculating it, will be agreed in writing before the original service contract begins.
  • Any additional migration fees, third-party licence costs and technical handover requirements will also be disclosed in the agreement.
  • Following payment of the agreed lawful charges and completion of the required written intellectual property assignment, we will provide the agreed transferable website files, access credentials and reasonable handover information.
  • No additional undisclosed buyout charge will be imposed.

8.5 Client Materials and Domain Names

  • The client retains ownership of its original branding, trademarks, content, photographs, business information and other materials supplied to us.
  • Domain registration, registrant details, renewal responsibilities and transfer arrangements will be specified separately in the service agreement and handled in accordance with applicable registrar and registry rules.
  • Hosting or managing a domain does not, by itself, establish ownership of the domain registration.

8.6 Ending a Managed Website Agreement

  • When a Managed Website agreement ends, the client’s right to continue using our proprietary website materials will depend on the agreed licence, any completed buyout and applicable law.
  • We will explain the available transfer, migration and termination arrangements in advance.
  • We will not improperly withhold client-owned content, personal data or domain rights, and any suspension, deletion or transfer of services will follow the agreement and applicable legal obligations.

9. Website Hosting, Domain Registration and Annual Renewals

9.1 Managed Website – Initial 12-Month Period

  • Where the client selects a Managed Website arrangement, the agreed website hosting, domain registration and basic hosting-related security services are included in the one-time website development fee for the initial 12-month service period.
  • For the Starter Website package, the development fee starts from £550. No separate hosting or domain renewal payment is required for the initial included service period.
  • The initial 12-month service period begins on the website’s confirmed go-live date, recorded in writing by Multimedia Creative Design.
  • Where a domain is registered or hosting is activated before the website goes live, Multimedia Creative Design will manage any difference between the supplier’s billing dates and the client’s agreed initial service period.

9.2 Annual Hosting and Domain Renewal

  • After the initial included period, continued website hosting and domain registration are charged annually in advance for each subsequent 12-month period.
  • The annual renewal prices, services included, renewal dates and applicable terms will be disclosed in the client’s written agreement before the original project begins.
  • Any proposed price changes will be communicated before the relevant renewal deadline.

9.3 Invoicing and Payment Deadlines

  • Multimedia Creative Design will normally issue an annual renewal invoice approximately 30 days before the relevant renewal deadline.
  • Payment reminders may be sent approximately 14 days and 7 days before that deadline.
  • The client must ensure that cleared payment is received at least 24 hours before the stated renewal deadline, or earlier where required by the relevant hosting provider, domain registrar or payment processing arrangements.

9.4 Automatic Supplier Renewals

  • Hosting and domain renewal arrangements may be configured to renew automatically with the relevant third-party provider.
  • Automatic renewal at supplier level does not necessarily mean that the client is enrolled in an automatic payment subscription.
  • The client’s payment arrangements, including whether renewal requires payment of an invoice or an authorised recurring payment, will be confirmed in the written agreement.

9.5 Non-Payment and Non-Renewal

  • If payment is not received by the applicable deadline, uninterrupted hosting or domain services cannot be guaranteed.
  • Multimedia Creative Design will provide reasonable notice before any suspension or termination within its control, subject to the relevant agreement, provider requirements and applicable law.
  • Domain expiry, restoration and transfer are also subject to the applicable registrar and registry policies.
  • The client may choose not to renew, subject to the agreed cancellation procedure and any binding third-party commitments.

9.6 Separation from Maintenance and SEO

  • Website hosting, domain registration and hosting-related security services are separate from optional website maintenance, SEO and ongoing technical support subscriptions.
  • The initial £550 Starter Website development fee does not include a monthly maintenance or SEO subscription.
  • Cancellation of an optional maintenance or SEO subscription does not automatically cancel the client’s hosting or domain services.

9.7 Third-Party Services

  • Additional third-party software, premium licences, email services, specialist security products and other external services are included only where expressly stated in the agreed package.
  • Any applicable third-party charges will be disclosed before they are incurred on the client’s behalf.
  • Nothing in this section excludes liability or consumer rights that cannot lawfully be excluded.

10. Website Maintenance and Technical Support

  • Ongoing support is provided according to the scope, service hours, response arrangements and exclusions set out in the client’s subscription agreement.
  • Unless expressly agreed, a maintenance subscription does not automatically include unlimited redesigns, new features, third-party licence fees or emergency support at all hours.
  • We may recommend updates or technical changes to improve security, compatibility or performance.
  • No website can be guaranteed to be completely free from technical faults or security risks.

11. SEO and Performance Services

  • We will use reasonable care and skill in providing SEO and website optimisation services.
  • Search engine rankings, traffic, sales and conversion results depend on numerous factors, including third-party algorithms and market conditions.
  • We do not guarantee specific rankings, traffic levels or commercial outcomes unless a particular deliverable or measurable obligation is expressly agreed in writing.

12. Confidentiality and Data Protection

  • We will treat confidential business information received from clients with appropriate care and use it for authorised service purposes.
  • Where our services involve personal data, the parties will comply with applicable data protection laws, including UK GDPR and the Data Protection Act 2018 where relevant.
  • If we process personal data on behalf of a client as a processor, an appropriate data processing agreement will be required where applicable.
  • Our website’s handling of personal data is further described in our Privacy Policy.

13. Cancellations, Refunds and Consumer Rights

  • Cancellation and refund requests are handled in accordance with our Refund & Cancellation Policy, the relevant service agreement and applicable law.
  • Consumers may have statutory cancellation rights for qualifying contracts concluded online or at a distance.
  • Where a consumer requests that services begin during an applicable cancellation period, the legal requirements concerning express requests, proportionate charges and cancellation rights will apply.
  • Subscription-specific statutory rights, including applicable cooling-off, reminder and cancellation requirements, will be honoured where the relevant legislation applies.
  • Nothing in these Terms & Conditions removes a consumer’s statutory rights concerning services supplied without reasonable care and skill.

14. Service Problems and Complaints

  • If a client believes that our services do not meet the agreed requirements, they should contact us with a description of the issue.
  • We will investigate and seek an appropriate resolution.
  • Where required by law, remedies may include repeat performance, correction of the service, a price reduction or a refund.

15. Liability

  • We are responsible for losses where liability cannot lawfully be excluded or restricted.
  • Nothing in these Terms & Conditions limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation or other liabilities that cannot lawfully be excluded.
  • Any additional limitation of liability for business clients must be expressly agreed, reasonable and enforceable under applicable law.

16. Website Content and Acceptable Use

  • Website content, including text, graphics, branding and original creative materials, is protected by applicable intellectual property laws.
  • Visitors must not misuse our website, attempt unauthorised access, distribute malicious software or interfere with its operation.
  • Any permitted use of website content must respect applicable intellectual property rights.

17. Changes to These Terms

  • We may update these website Terms & Conditions to reflect changes in our business practices, services or legal requirements.
  • The updated version will be published with a revised date.
  • Changes to existing service contracts will be governed by the agreed contract terms and applicable law. Publishing revised website terms does not automatically change an existing contract.

18. Governing Law and Disputes

  • These Terms & Conditions are governed by the laws of England and Wales, subject to mandatory consumer protections and any other applicable legal requirements.
  • We encourage clients to contact us first so that concerns can be investigated and resolved.
  • Nothing in this section deprives consumers of any mandatory right to bring proceedings in a court with jurisdiction.
